Open Records Request

Under the Georgia Open Records Act, all public records are available for inspection and copying unless they are specifically exempted from disclosure under the law. If a government agency or custodian of public records withholds a public document from production under an Open Records Request, the agency must cite the specific statutory provision of Georgia law that exempts the record from being produced.

As a government agency, we understand that almost all our of actions are available for public review. We are dedicated to meeting all open records requests received in writing in a timely manner. Much of the information on this web site is provided to give easy access to public information.

Open records requests should contain the following:

  • Requestor’s name
  • Phone number and return address
  • Specific type of information being requested including names, dates, times, locations, and case numbers (if available).
  • Reference the appropriate Georgia or Federal Public Information or Record Law under which you are applying.

To submit a request, fill out the form below. Provide as much information as possible to avoid delays in processing. Depending on the type of information requested, charges may be incurred. If this is the case, we will contact you prior to your request being processed. If there is a fee it can be paid online at our online payment site under service fee. You can also pay by check or money order mailed payable to the Burke County Sheriff's Office and mailed to P.O. Box 702 Waynesboro, GA 30830 or in person by cash, card ($4.99 convenience fee), check, or money order.Also note that individuals and attorneys wishing to obtain information concerning a case in which an individual is awaiting trial may be required to contact the Burke County Clerk of Superior Court and file appropriate discovery motions.

All open records will be delivered to the Records Manager, who will determine which requests may need guidance from an attorney or can be released immediately. The Records Manager will respond to the requestor within (3) business days of receipt. All requests may be released upon approval by the Records Manager. Prior to the release of the records, all personal information pertaining to employees will be redacted. Requestors will be notified within (3) business days of the estimated costs associated with processing the records, if there are any. If greater than $25.00 the agency will defer search and retrieval of the records until the requestor agrees to pay the estimated cost. If the cost exceeds $500.00 the agency will require prepayment. The agency will charge the hourly rate of the lowest-paid full-time employee that can complete the request. There is no charge for the first 15 minutes.
